1. Agreement to Terms

By accessing and using the Aware Flow HK website (awareflowhk.com) or purchasing our products, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our website or purchase our products.

These Terms constitute a legally binding agreement between you (the "Customer" or "You") and Aware Flow HK ("we," "us,” or "our").

2. Denitions

"Products" refers to Flowstar, Dapo, and other flow arts spinning toys and related accessories offered for sale through our website.

"Service" refers to our website, e-commerce platform, and all related services we provide.

"Order" refers to your request to purchase Products from us.

"User" means any person who accesses or uses our Service.

3. Eligibility

By placing an Order, you warrant that:

  • You are at least 18 years of age or have parental/guardian consent
  • You are legally capable of entering into binding contracts
  • You will provide accurate and complete information
  • You will comply with all applicable laws and regulations

4. Products and Availability

  • All Products are subject to availability
  • We reserve the right to limit quantities of any Products
  • Product descriptions, images, and specifications are provided for general information and may vary slightly from actual products
  • We make reasonable efforts to display accurate colors and details, but cannot guarantee exact representation on all devices
  • Prices are subject to change without notice

5. Orders and Payment

5.1 Placing Orders

When you place an Order:

  • You make an offer to purchase the Products
  • We will send you an order confirmation email
  • Acceptance of your Order occurs when we ship the Products or send dispatch confirmation
  • We reserve the right to refuse or cancel any Order at our discretion

5.2 Pricing

  • All prices are displayed in Hong Kong Dollars (HKD) unless otherwise stated
  • Prices include applicable taxes unless otherwise specified 
  • Shipping costs are additional and calculated at checkout
  • We reserve the right to correct pricing errors

5.3 Payment

  • Payment must be received before Order fulfilment
  • We accept major credit cards, PayPal, and other payment methods as indicated at checkout
  • Payment processing is handled securely through third-party payment providers
  • You authorize us to charge the payment method provided for the total Order amount

6. Shipping and Delivery 

6.1 Shipping Policy

  • We ship to Hong Kong and select international destinations
  • Delivery times are estimates and not guaranteed
  • Shipping costs and delivery timeframes are displayed at checkout
  • You are responsible for providing accurate shipping information
  • Risk of loss transfers to you upon delivery to the carrier

6.2 International Orders

For international shipments:

  • Customers are responsible for all customs duties, taxes, and import fees
  • Delivery times may vary based on customs processing
  • We comply with all applicable import/export regulations in Hong Kong[1]

6.3 Undeliverable Orders

If a shipment is returned as undeliverable due to incorrect address or customer unavailability:

  • You will be contacted to arrange reshipment
  • Additional shipping charges may apply
  • Refunds will be issued minus original shipping costs after the Product is returned to us

7. Returns and Refunds

7.1 Return Eligibility

Products may be returned within 7 days of delivery if:

  • The Product is unused and in original condition
  • Original packaging and all accessories are included
  • The Product has not been damaged or modified
  • You provide proof of purchase

7.2 Non-Returnable Items

The following cannot be returned:

  • Products that have been used or practiced with
  • Products with removed tags or altered packaging
  • Custom or personalized Products
  • Products showing signs of wear or damage

7.3 Return Process

To initiate a return:

  1. Contact us at awareflowhk@gmail.com within 7 days of delivery
  2. Provide your Order number and reason for return
  3. Await return authorization and instructions
  4. Ship the Product back using a trackable shipping method
  5. Customer is responsible for return shipping costs unless the Product is defective or we shipped the wrong item

7.4 Refund Processing

  • Refunds are processed within 7-14 business days after we receive the returned Product
  • Refunds are issued to the original payment method
  • Original shipping charges are non-refundable unless we made an error
  • We will inspect returned Products before issuing refunds

8. Product Warranty and Defects

8.1 Warranty

  • Products are warranted against manufacturing defects for 30 days from delivery
  • This warranty does not cover normal wear and tear, misuse, or accidental damage
  • To claim warranty service, contact us with proof of purchase and description of the defect

8.2 Defective Products

If you receive a defective Product:

  • Contact us within 7 days of delivery
  • We will arrange replacement or refund at our discretion
  • Return shipping for defective Products will be covered by us

9. Intellectual Property

9.1 Our Rights

All content on our Service, including:

  • Product designs, images, and descriptions
  • Logos, trademarks, and brand names
  • Website design, layout, and functionality
  • Videos, tutorials, and educational content
  • Text, graphics, and multimedia materials

These are the exclusive property of Aware Flow HK or our licensors and are protected by Hong Kong and international intellectual property laws.

9.2 Your Rights

To the maximum extent permitted by Hong Kong law:

  • Our total liability for any claims arising from your use of Products or Service shall not exceed the amount you paid for the Product in question

  • We are not liable for damages arising from product misuse, accidents, or improper care
  • We are not responsible for injuries sustained while using our Products

Flow arts Products involve physical movement and skill development. Users assume all risk of injury. We recommend:

  • Practicing in safe, open spaces
  • Starting slowly and building skills progressively
  • Being aware of surroundings and other people
  • Taking appropriate safety precautions

19.2 Arbitration

If informal resolution fails, disputes shall be resolved through binding arbitration in Hong Kong in accordance with the Hong Kong International Arbitration Centre (HKIAC) rules, except where prohibited by law.

19.3 Class Action Waiver

You agree to bring claims against us only in your individual capacity and not as part of any class or representative action.

20. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

21. Entire Agreement

These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Aware Flow HK regarding the Service and supersede all prior agreements and understandings.

22. No Waiver

Our failure to enforce any right or provision of these Terms will not constitute a waiver of that right or provision. No waiver shall be effective unless in writing.

23. Assignment

You may not assign or transfer these Terms or your rights under these Terms without our prior written consent. We may assign these Terms without restriction.

24. Force Majeure

We are not liable for failure to perform our obligations due to circumstances beyond our reasonable control, including but not limited to natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation, fuel, energy, labor, or materials.
